Privacy and data policy.

Last updated: 8 November 2025

At Swan Consulting, we are committed to protecting the personal data entrusted to us. This Privacy and Data Policy explains how we collect, use, and protect personal data in accordance with the Swiss Federal Act on Data Protection (FADP).

1. Who We Are

Swan Consulting provides workplace mental health consulting and advisory services. We work with organisations to identify psychosocial hazards and implement mental health initiatives. Our activities include, but are not limited to, such services as conducting workplace mental health assessments, developing psychosocial policies and programs, training coordination, providing impact evaluations, and implementation advisory.

2. Legal Basis and Compliance

We process personal data strictly in line with the Swiss Federal Act on Data Protection (FADP) and other applicable Swiss regulations. All processing is limited to what is necessary, proportionate, and transparent.

3. Personal Data We Collect

We may collect personal data in the following contexts:

  • Website visitors: Information such as name, email, and details you provide via forms; technical data such as IP address, device type, and browsing activity.

  • Survey respondents: Responses to workplace mental health and psychosocial risk surveys, which may include demographic details or subjective feedback. Wherever possible, data are anonymised or aggregated.

  • Focus group participants: Opinions and insights shared during group sessions. Individual contributions are never attributed in reports.

4. Purpose of Processing

We process personal data only for the following purposes:

  • Conducting workplace assessments and providing tailored recommendations.

  • Improving our services and supporting mental health initiatives.

  • Communicating with clients, participants, and stakeholders.

  • Producing research and anonymised reports.

  • Complying with Swiss legal and regulatory requirements.

We do not use personal data for any purpose other than those stated above.

5. Data Protection and Security

  • All personal data are stored on secure systems located in Switzerland or in jurisdictions recognised by Switzerland as providing adequate protection.

  • Access to data is restricted to authorised Swan Consulting personnel.

  • Technical and organisational measures (encryption, access controls, secure storage) are in place to prevent unauthorised access, misuse, or loss.

  • Survey and focus group responses are anonymised or the use of a pseudonym is ascribed wherever possible.

6. Cross-Border Data Transfers

Some of our trusted service providers may process data outside Switzerland (for example, providers of secure survey tools, email services, or cloud storage).

  • Where such transfers occur, we ensure compliance with the FADP by using only providers in countries with adequacy decisions from the Swiss Federal Council (such as EU/EEA member states).

  • If providers are located in countries without adequacy recognition (e.g., the United States), transfers are safeguarded by standard contractual clauses (SCCs) or other legally approved mechanisms.

  • We require all service providers to implement strong technical and organisational security measures.

7. Disclosure of Data

We do not sell or trade personal data. Disclosure may occur only in the following cases:

  • To client organisations, always in aggregated or anonymised form.

  • To trusted service providers who process data on our behalf under strict contractual safeguards.

  • When legally required by Swiss authorities or applicable law.

8. Retention of Data

We retain personal data only as long as necessary for the purposes outlined above, or as required by Swiss law. Where data are no longer needed, they are securely deleted or anonymised.

9. Your Rights under Swiss Law

Under the FADP, you have the following rights:

  • Access: Request a copy of your personal data.

  • Correction: Request corrections or updates to inaccurate data.

  • Deletion: Request deletion of personal data when processing is no longer necessary.

  • Objection: Object to processing in certain circumstances.
